These terms of use (the “Terms of Use”) govern your use of our website www.betterhero.in (the “Website”) and our “Better Hero” application for mobile and handheld devices (the “App”). The Website and the App are jointly referred to as “Platform”. Kindly read these Terms of Use carefully before you proceed and use the services provided by the platform. If you do not agree to these Terms of Use, you may not use the services on the Platform, and we request you to uninstall the App. By installing and using the Platform, you shall be agreeing with Better Hero and you have accepted the Terms of Use and other Better Hero policies as posted on the Platform and amended from time to time, which takes effect on the date on which you download, install or use the Platform, and create a legally binding arrangement to abided.

The Platform is owned and operated by Shauka Sociotech Private Limited, a private limited company incorporated under the Companies Act, 1956 and having its registered office at Near Santoshi Mata Mandir new Shanti Nagar, Bithoriya No.1, New Shanti Nagar, Bithoriya No.1, Nainital, Haldwani, Uttarakhand, India, 263139

For the purpose of these Terms of Use, wherever the context so requires, “you”, “user” shall mean any natural or legal person who shall transaction on the Platform by providing registration data while registering on the Platform as a registered user using any computer systems. The terms “Better Hero”, “we”, “us” or “our” shall mean Shauka Sociotech Private Limited.

Amendments

These Terms of Use are subject to modifications. We reserve the right to modify or change these Terms of Use and other Better Hero policies at any time by posting modified documents on the Platform.

You shall be liable to update yourself of such changes, if any, by accessing the same. You shall, at all times, be responsible for regularly reviewing the Terms of Use and the other Better Hero policies and note the changes made on the Platform. Your continued usage of the Services after any change is posted constitutes your acceptance of the amended Terms of Use and other Better Hero policies. 

By accepting these Terms of Use, you also accept and agree to be bound by the other terms and conditions and Better Hero policies as may be posted on the Platform from time to time.

Use of Platform and Services

All commercial, timelines, Campaigns terms are offered by and agreed to between user and NGO, trust and societies alone with respect to services / Campaign being offered by the NGO, trusts, societies. 

The term Beneficiary will stand for (NGO, trusts, societies) and Campaign shall mean the and refer to the various service/bundle of service by one NGO, Trust or societies or beneficiary to provide help, assistance, amount or material under their campaign. The help, assistance, material and amount shall be termed as Target/Goal. 

The commercials, timeline terms include payment terms, date, period and mode of delivery/assistance/help, campaign Target/Goal and services and the usage of funds along with the regular updates of the campaign user has funded. 

Better Hero does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the user and Beneficiary. Better Hero may, however, offer support services to Beneficiary and users with the platform in respect to Campaign and campaign details, mode of payment, payment collection. The amount and target for a particular campaign run is determined by the beneficiary itself and Better Hero has no role in determining of Target in any way whatsoever.

User Responsibilities

Authorized User agrees not to reproduce, sell, resell or exploit for any commercial or non-commercial purposes, any portion of the Service or the Site. Without our written permission, Authorized User may not: (a) allow, enable, or otherwise support the transmission of mass unsolicited, commercial advertising or solicitations via email, (b) access the Service using any high volume or automated means, (c) place pop-up windows over its pages, or otherwise affect the display of its pages or (d) access the app or the Service in any manner that violates our Privacy Policy. All information that Authorized User provides to us shall be true, accurate and current.

Authorized User agrees not to use the Service to: (a) violate any local, state, national or international law, (b) impersonate any person or entity, or otherwise misrepresent Authorized User’s affiliation with a person or entity, (c) stalk, harass or harm another individual, (d) promote or glorify hatred, violence or racial intolerance, (e) collect or store personal data about other Authorized Users or (f) disobey any requirements, procedures, policies or regulations of networks connected to the Site or the Service, or interfere with or disrupt the Service, the Site or servers or networks connected to the Service or the Site.
